Who Know's This Seller?

General Discussion about almost anything Teardrop or camping related

Postby Denny Unfried » Mon Feb 14, 2005 9:28 pm

I think whoever it is - is trying to bring my web site down. This afternoon someone has been there for almost three hours and downloaded over 1000 pages. Probably wants to use up my alloted bandwidth. Anyway I shut the side off temporarily.

If you play around with JAlbum you can embed any text you want in any location and with as much transparency as you want. Even if you don't use the actual album, but run the pics through the batch process to resize the pics and add the watermark, it works quite well.

I think we should just flood his Ebay "Ask Seller a Question" box. or maybe get his email address from ebay and give it to every Spammer on the planet. All those Nigerian Lawers who need your help to claim millions of dollars...They'd love to hear from him.

Just a thought

Happy trails

Re: I bought one from Shrug

In October I bought one on ebay from Shrug53, aka T Padgett . It included copyrightable material from JPJenning. He too used an alias which is no longer active on the web but has some of the same graphics as the seller in question.

I bought this CD when I first became interested in teardrops.

I don't have any documentation that came with it anymore and I can't remember who the seller was.
In my opinion you'd have to be pretty lost as a designer/builer for this CD to be of any use.
Historically, it does serve a purpose, I guess.
This may well be an illegally produced CD, because there is a section right from Grant's website on it.

Maybe it's my viking heritage coming through, but sometimes the best way to deal with people like this is to kick their a$$. This guy obviously has no regard for the law. If you can find out his home town and mailing address, I would recommend that those who have been wronged by him file a class-action lawsuit for copyright infringement and bankrupt the bastard.

Just in case a lawyer is reading this post, I in know way suggested that anyone commit any violence against the seller of these illegal CDs. My statement above was general in nature and was not directed toward any individual.

This guy let a webwacker program run from yesterday on my site from about noon into today downloading page after page. He has a dynamic IP (dial up) so couldn't be traced. He's got to be kidding and he could run that program till his hard drive fell out and all he'd do is tie up his phone line. I added the eBay alert to more of my pages.

His one web page is a sub-page of a womens rugby site. He must have tried to sell from that page at one time because in the source code is the comment of a pay-pal graphic that was once there.

Dean, I too bought that cd. It didn't meet my expections but it did have history. Is it stolen material? The web site is http://www.teardropplans.com
I payed through paypal and it went to Web Direct INC The name is Dave Brainard.
I save all my receipts so if anymore info is needed I share what I have.

Dennis,
Does yours have a pdf file named TailsandTrails?
Mine does and it's an outdated web page from Li'l Bear-Tag-Alongs.
(That's Grant's website)
I was assuming that this was stolen material, but I could be wrong...
Maybe Grant let this guy use that?

"Well,
Imagine that...He watermarked all his stolen loot. "

I wonder if it has dawned on anyone, yet, that "les_lea" aka Daniel Cary, aka who-knows what, or cohorts of the same, is/are member/members of this 'Board?. They're watching all of this, occasionally adding something to the mix to stir things up even more (ie: the "water-marked" blurprints), and are sitting back and laughing their asses off at all the comotion they've caused. They don't have to run to the bank 'cause they've got direct deposit from PayPal and all the rest, so they just get to sit on their big fat butts and let us entertain them while their bank account just keeps getting bigger (not from us anymore, but the poor unsuspecting souls who are still buying their B.S.).

There's a fungus among us, folks ... and I've got a pretty good idea who it is ... I just haven't figured out all their alias' yet. I've got ONE nailed, though ...

He/They/It must have read our thread about adding a code so that you can't right click and copy and image.
I just looked at an auction by EZZYBAY and I see a rear shot of one of those awesome woody teardrop recreations built by Wayne Davis of Texas. I go to right click on the image and wouldn't you know it, I get this pop up window that says, "Copyright 1999-2004 EZZYBAY. All Rights Reserved."

Here's another one of EZZYBAY'S auctions and I think this is a picture of Marjorie's trailer. (EZZYBAY has that one copyrighted also with pop up window)

... and Another (Sorry, I don't know who's trailer this one is)

... and Another (Looks like the cycle is starting all over again, This is Roly's trailer)

So what if we can't right click on their auctions. We aren't the ones that are trying to steal the pics. We know that the pics are stolen, we can go to the original source and ask them. Kinda dumb on their part.

I was right clicking to see what the properties said.
I just think it's ironic that we talk about something here and then boom there it is... and you are right it is very stupid to post copyright signage on something is stolen.

Maybe a group of us could sell a pamphlet on Ebay for one cent, just to tell customer's to come here if they are interested in learning about teardrop trailers?

Well it looks like Ross and Grant, and whoever else has stolen copyright material showing up on ebay has some recourse...

Here's the letter I got from ebay:

Hello Mike,

Thank you for contacting us regarding this issue. We developed our VeRO
Program to address situations like yours.

As you know, eBay does not buy or sell any items; we act only as a venue
that enables others to do so. As such, we neither see nor inspect any
items that are offered for sale on the site. However, recognizing that
some posted items may infringe certain intellectual property rights, we
have set up specific procedures which enable verified rights owners to
identify and request removal of allegedly infringing listings. These
procedures are intended to substantially comply with the requirements of
the Digital Millennium Copyright Act, 17 U.S.C. section 512. Click on
the following link to access the Digital Millennium Copyright Act.

http://www.qlinks.net/comdocs/uscopyright.htm

We encourage you to join our VeRO Program so you can immediately take
advantage of its benefits, which include:

- Direct access to an identified customer support group dedicated to
servicing the requests of VeRO Program participants;

- Ability to report listings in which your intellectual property or
other proprietary materials are offered, reproduced, or otherwise used
in a manner that violates or threatens to violate your rights, and to
have such listings terminated;

- Dedicated priority email queues for reporting alleged infringements;

- Ability to create an eBay "About Me" page containing information you
wish to convey to eBay users;

- Ability to request detailed contact information pertaining to sellers
who post listings that may violate your rights.

We expect the list of benefits to grow in the future, and we will keep
you apprised of any enhancements to the Program.

For your convenience, you can download a copy of our Notice of Claimed
Infringement (NOCI) form by clicking this link:

http://pages.ebay.com/help/community/NOCI1.pdf

You will need Adobe® Acrobat Reader to view and print our NOCI form. If
you do not have Adobe® Acrobat Reader, you can download a free copy at
Adobe's web site:

http://www.adobe.com/products/acrobat/readstep.html

Please sign and send it back to us by fax at (408) 516-8811.

After we receive your first NOCI, we will send you an electronic version
of our NOCI form so you can send future notices to us via email.

Remember, time is of the essence because items are listed for a limited
duration. Once we have received your Notice of Claimed Infringement in
proper form, we can remove the referenced listing(s). Be sure to
identify the specific listings by number; the user's screen name or user
I.D. is not sufficient.

We look forward to receiving from you a completed VeRO Program Notice of
Claimed Infringement and working with you in the future.

If you have questions, please write to us at [email protected].

Regards,

Yuri
